Welcome to Agorum, a talent listing platform that provides users, known as "talents," the opportunity to create a public profile and list their work. These Terms of Service ("Terms") govern your access to and use of the Agorum website, services, and applications (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
To use the Platform, you must create an account by manually registering on the "signup" page using your first and last name, phone number, and email. You may also choose to register with Google OAuth. By creating an account, you agree to provide accurate and complete information and to keep your account information up-to-date. You are responsible for maintaining the security of your account and password. Agorum cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
Currently, users do not have to pay any fees to use the Platform in its basic form. However, Agorum reserves the right to introduce fees for additional features or services in the future. Any such fees will be communicated to users in advance.
As a service provider, Agorum will seek to protect the privacy and integrity of users' data. Users, as clients, agree to utilize the Platform as intended and in compliance with these Terms and any applicable laws and regulations. Agorum reserves the right to share any and all user data with third-party services, in accordance with our Privacy Policy.
Agorum, its logo, and any other assets displayed on the Platform are copyrighted and trademarked. The Platform and its content, features, and functionality are and will remain the exclusive property of Agorum and its licensors. Users are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the Platform solely for personal, non-commercial purposes.
Users may upload images to the Platform as part of their public profile. By doing so, users affirm that they have legal ownership or permission to use the image and assume full legal responsibility for any claims of copyright infringement or other legal issues related to the image. Agorum disclaims all liability and responsibility for any user-generated content uploaded to the Platform and reserves the right to remove any content that violates these Terms or applicable laws.
Agorum reserves the right, in its sole discretion, to suspend or terminate any user's account and access to the Platform at any time, without notice or liability, for any reason, including but not limited to violation of these Terms, illegal activity, or other misconduct.
If a dispute arises between you and Agorum, please email dispute@agorum.com to report the issue. We will work in good faith to resolve the dispute; however, if we are unable to do so within a reasonable time, either party may submit the dispute to binding arbitration in accordance with the rules of a recognized arbitration organization.
To the maximum extent permitted by applicable law, Agorum and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from your use of the Platform or any services provided thereon.
You agree to indemnify, defend and hold harmless Agorum and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights, including but not limited to any copyright, trademark, or privacy rights.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Agorum operates, without regard to its conflict of law provisions.
Agorum reserves the right to update or modify these Terms at any time. You should periodically review the most current version of these Terms. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of such changes.
